  • Mind of a Serial Killer. The Experience

    SAFETY ACKNOWLEDGEMENT AND RISK ASSUMPTION

    The Experience Organizers have implemented Rules & Safety Measures for “Mind of a Serial Killer. The Experience” (the “Experience”) which can be found on the back page of this Safety Pledge and Liability Waiver. These Rules and Safety Measures are intended to keep Experience guests safe, but they cannot prevent all risks associated with your attendance at the Experience. 

    (1) SAFETY PLEDGE 

    By entering this Experience, you freely and knowingly confirm that you undertake: 

    ● that you are 18 years old or older. You may be required to present valid government-issued identification as a condition of entry.

    to be responsible for your safety and actions at the Experience; 
    ● to follow the Rules and Safety Measures of the Experience; 

    ● to diligently follow the instructions of staff at the Experience; and 

    ● not to knowingly put others at risk. 

    You understand that your failure to do any of the above: 

    Might put yourself and the rest of the attendees and staff at the Experience at risk; and 
    Might result in your removal from the Experience. 
    Might result in legal action being taken against you.
    If you fail to follow the above pledge, you may be asked to leave the Experience and will not be entitled to a refund. 

    (2) ACCEPTANCE OF RISK AND ACKNOWLEDGEMENTS

    By attending the Experience, you freely and knowingly confirm that you: 

    ● Assume all Risks and acknowledgements associated with attending the Experience; 

    ● Will follow all instructions from Experience staff, and will not act in a way that puts other Experience guests at risk; 

    ● Have read, understand and will follow the Rules & Safety Measures; and, 

    ● Waive your rights concerning Experience Organizer’s liability, as outlined below. 

    What are the RISKS AND ACKNOWLEDGEMENTS in participating in the Experience? 

    You understand and acknowledge that the Experience may include emotionally disturbing themes and materials related to violent crime and its impacts. The Experience is presented for educational and informational purposes.
    Where the Experience refers to real-world cases, it is intended to be based on verifiable facts. Any fictionalized or dramatized elements (if any) will be clearly disclosed. The Experience is presented in a respectful, non-sensational manner, including in memorial recognition of the victims of the cases portrayed.
    Where immersive or interactive elements are included, they are designed to encourage reflection and convey the gravity of the subject matter, and may be intentionally confronting; they are not intended to trivialize or treat these events lightly.
    You acknowledge that exposure to such content may cause emotional distress, and you elect to attend voluntarily. You further acknowledge and accept that the purposes of the Experience Organizers include: (i) education and public awareness; (ii) encouraging critical reflection on the causes, consequences, and impacts of violent crime; (iii) promoting respectful remembrance of victims; and (iv) supporting responsible discussion of prevention, safety, and societal responses.
    The above risks of emotional distress may be heightened for persons with medical conditions, including (without limitation): heart disease; seizures; high blood pressure; anxiety or emotional disorders; medical sensitivity to intense lighting, sounds or disorienting stimuli; and pregnancy. 
    What does this mean? 

    To the fullest extent permitted by New York law, and except where the Experience Organizers acted with gross negligence, recklessness, willful misconduct, or intentional wrongful intent, you agree to waive, release, and covenant not to sue the Experience Organizers for any claims arising out of or relating to your attendance at, participation in, or exposure to the Experience and its content, including (without limitation) claims for injury (including aggravation of a preexisting medical condition), emotional distress or losses, and property damage or destruction, as well as claims for defamation, obscenity, Right of Privacy and Public Disclosure of Private Facts, invasion of privacy, and intentional infliction of emotional distress. Notwithstanding the foregoing, nothing in this document shall be construed to release the Experience Organizers from liability arising from their own negligence to the extent prohibited by New York law.

    CHOICE OF LAW: The law of the State of New York will apply to this document. 

    Experience Organizers refers to: EXHIBITION HUB US HOLDING LLC and all of their respective affiliates and subsidiaries, as well as Fever Labs Inc and all of their respective affiliates and subsidiaries.

    IMPORTANT: BY SIGNING THIS DOCUMENT, YOU ARE ACKNOWLEDGING RISKS, MAKING ACKNOWLEDGEMENTS AND GIVING UP CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE FOR ORDINARY NEGLIGENCE, TO THE EXTENT PERMITTED BY NEW YORK LAW

     

     

    Rules and Safety Measures 

    The Rules

    The most important thing is to follow the Rules, which include: 

    This document, our staff instructions, and any posted signage at the Experience itself. 

    Here are some rules you must follow at the Experience: 

    ●Participants must be 18 years old or older. You may be required to present valid government-issued identification as a condition of entry.

    ● You may not enter the Experience with any of the following: 

    ○ alcohol or food, 

    ○ animals (other than service animals), 

    ○ drugs and/or drug paraphernalia, 

    ○ weapons of any kind (including replicas), flammables, torches, or lasers, 

    ○ audio recording devices, professional cameras, selfie sticks/tripods, or 

    ○ promotional items, unauthorized solicitations (including flyers, samples, giveaways). 

    ● This is an educational experience: respectful behavior is required at all times.

    ●No glorifying, celebrating, or joking about perpetrators, violence, or victims.

    ●No disruptive conduct (shouting, reenactments, shock-seeking behavior) or disturbing other guests.

    ●No clothing/props that promote or romanticize violence, serial killers, or harassment.

    ●Vaping or smoking are strictly forbidden. 

    ● Hostile or harassing behavior may result in your removal from the Experience. 

    ● Please stay on the designated walking trail and paths. 

    ● Dress appropriately for light  activities. It is recommended to wear closed toed shoes. 

     

     Safety Measures

    Safety information and directions will be clearly posted on signage throughout the Experience. To keep you and your group safe, please carefully read and follow all instructions. 

    Our staff are fully trained on all safety measures and procedures.
